Hon. Justice Miatta M. Samba yesterday granted Le100 million bail with one surety to opposition politician, Alie Kabba (Respondent) after plea from his counsel.


Earlier, the State prosecutor Ahmed G. M. Bockarie Esq. called Inspector Umaru Finney Kamara who confirmed he interrogated Alie Kabba at a time he was under investigation at CID to tender exhibit AVK which contains Alie Kabba’s indictment in court following a miselenious application.

According to the State Counsel, Ahmed G. M. Bockarie Esq. the application dated 12th February 2016 profer three counts indictment bordering on Bigamy, making false declaration on license of civil marriage Act and making false statement contrary to the perjury Act pursuant to rule 10 of the indictment.

Explaining to the judge, inspector Umaru Finney Kamara told the judge that he is attached at the major incident unit at the Criminal Investigations Department (CID), headquarters at Pademba Road in Freetown.

“I recognized the Respondent Alie Kabba. And on the 23rd December 2015 I was on duty at CID headquarters when I had curse to interview and interrogate him in respect of an alleged Bigamy, making false declaration on license of civil marriage Act and making false declaration on oath”, He said.

“On the 30th December 2015 I further interrogated him and later charged him to court with the offences for which he has been indicted” inspector Kamara added.

The State prosecutor authorized inspector Umaru Finney Kamara to tendered exhibit AVK and further applied for a date to be set for Alie Kabba to tried in the High Court.

The lead counsel Francis Ben Keifala Esq. joined by lawyer Umaru Koroma Esq. applied for bail for his client. He informed the judge that Alie Kabba is already on bail upon conditions set by the Magistrate court which he has satisfied and have not violated.

“My Lord, Alie Kabba came to court upon the information that he is to be here. He has reliable and credible Sierra Leonean sureties who are willing to vouch for his appearance in court if granted bail” he said.

“Apart from the fact that he came to court by himself, we vouch for his safe conduct and appearance before you. He is a citizen, ordinarily resident within the jurisdiction of Freetown. He is no flight risk and will not interfere with prosecution witnesses” he added.

Lawyer F. B. Keifala said the application is pursuant to section 79 of the Criminal Procedure Act and rule 11 of the indictment of the ex-officio indictment of 1979. He appealed to the judge for the bail granted to his client at Magistrate Court be maintained.

Counsel for the State did not object to bail on the grounds that bail was the discretion of the judge.

After listening to the application for bail and the comments made by the State Counsel, Justice Samba granted bail to Alie Kabba in the sum of Le100 million leones. She said the application would no longer be required to produce two sureties but one who must have property whose location is limited to freetown and must also show a recent utility bill valid from November 2015 to date.

She ordered that the Respondent Alie Kabba must filed all his depositions within seven days and must surrender all his travelling documents and must not leave the Country until the end of his trial.

Bail, she authorized must be approved by the Master and Registrar of the High Court.

Meanwhile, the matter was adjourned to the 16th March 2016 as the date slated for trial.
